Welcome to WeBuyThat.com (the "Service"), operated by Referrals For America Inc, located in Dayton, Minnesota ("we," "us," or "our"). By using this website or submitting information through our forms, you agree to these Terms of Use and our Photo Use Policy described below. If you do not agree, please do not use the Service.

1. How WBT Works

WeBuyThat.com is a referral platform that connects sellers of used items with local buyers in our network. Sellers submit information about items they want to sell. Buyers in the seller's geographic area receive notifications about matching submissions and may choose to claim referrals to receive the seller's contact information. Once a referral is claimed, the buyer and seller communicate directly to negotiate price, arrange pickup, and complete the transaction. WBT is not a party to any sale and does not handle payments, item transfers, or transaction disputes between buyers and sellers.

2. Seller Terms

By submitting a seller form, you represent that:

  • You are the legal owner of the items being submitted, or you are authorized to sell them.
  • The information you provide (descriptions, photos, location, contact details) is accurate and truthful.
  • You are at least 18 years of age.
  • You agree to communicate in good faith with any buyer who claims your referral.
  • You understand that WBT does not guarantee any sale or buyer interest in your items.

3. Buyer Terms

By signing up as a buyer, you represent that:

  • You are at least 18 years of age and legally able to enter into purchase transactions.
  • You will use referral information only for the purpose of contacting sellers about specific items.
  • You will not share, resell, or distribute seller contact information to third parties.
  • You will communicate professionally and respectfully with sellers.
  • You understand that referral fees are non-refundable once a referral has been delivered to you, regardless of whether a transaction completes.

4. Marketing License & Photo Use Policy

When you submit information as a seller, you grant WeBuyThat.com a perpetual, worldwide, royalty-free license to use the following for marketing and promotional purposes:

  • Your first name (last name is never used in public marketing)
  • Photos you submit of your items
  • Your general location (city and state only)
  • Categories and descriptions of items you submitted

This license allows us to display your submission on our website (including but not limited to the homepage carousel, activity page, and similar features), and on social media platforms including but not limited to:

  • Facebook, Instagram, X (formerly Twitter), TikTok, YouTube, Pinterest, LinkedIn, Threads, Snapchat, and any other current or future social or marketing platforms

What we NEVER share publicly:

  • Your last name
  • Your phone number
  • Your email address
  • Your exact ZIP code

Your phone number and email address are shared only with buyers who have claimed your specific referral, so they can contact you directly about your items.

5. Privacy

We respect your privacy. Personal contact information (last name, phone, email, exact ZIP code) is shared only with buyers who claim a referral to your specific submission. We do not sell your data to third parties. Information is stored securely in our database and may be retained for operational purposes including dispute resolution, marketing analytics, and legal compliance. You may request deletion of your information by contacting us at the address below.

6. Acceptable Use

You agree not to:

  • Submit fraudulent, misleading, or illegal content.
  • List items that are illegal to sell, counterfeit, stolen, or violate the rights of others.
  • Use the Service to harass, threaten, or harm any other user.
  • Attempt to circumvent the platform to avoid referral fees or platform terms.
  • Scrape, copy, or systematically extract data from the Service.
  • Use automated tools, bots, or scripts to interact with the Service without authorization.

7. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free. We do not endorse, verify, or guarantee any seller, buyer, item, or transaction. All sales are between buyer and seller directly. We are not responsible for the quality, safety, legality, or accuracy of items listed.

8. Safety & Due Diligence

For sellers: When meeting buyers, we recommend meeting in well-lit public locations when possible, having someone present, and trusting your instincts. You transact at your own risk.

For buyers: Inspect items before purchase. We do not verify the condition or authenticity of items posted. You transact at your own risk.

WBT is not responsible for any losses, damages, injuries, or disputes arising from interactions between buyers and sellers.

9. Limitation of Liability

To the fullest extent permitted by law, WeBuyThat.com and Referrals For America Inc shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising from your use of the Service. Our total liability to you for any claim arising from these Terms or the Service shall not exceed the lesser of (a) the total amount of fees you have paid to us in the 12 months preceding the claim, or (b) one hundred dollars ($100) USD.

10. Indemnification

You agree to indemnify, defend, and hold harmless WeBuyThat.com, Referrals For America Inc, and our officers, directors, shareholders, owners, employees, agents, contractors, affiliates, and subsidiaries from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of the rights of any third party.

11. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. Material changes will be communicated via email when reasonable.

12. Governing Law

These Terms are governed by the laws of the State of Minnesota, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Hennepin County, Minnesota, and you consent to the personal jurisdiction of those courts.
